Welcome to RaceLauncher

These Terms and Conditions ("Terms") govern your access to and use of RaceLauncher, a mobile application (“App”) developed and operated by Argos Digital Media, LLC (“we,” “us,” or “our”). By downloading or using RaceLauncher, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the App.

1. Eligibility

You must be at least 13 years old to use RaceLauncher. By accessing or using the App, you affirm that you meet this requirement and are legally capable of entering into a binding agreement.

2. Purpose of the App

RaceLauncher is designed to simulate synchronized race starts between two users using a virtual “Christmas Tree” system. Users can select between several start modes including Flashlight, Roll Race, Sportsman Tree, and Pro Tree.

• RaceLauncher is intended solely for entertainment and educational use.
• It does not promote, support, or condone illegal street racing, unsafe driving practices, or any activity that violates the law.

You agree to:

• Use RaceLauncher only in compliance with all applicable laws
• Never operate the App while actively driving a vehicle
• Use RaceLauncher responsibly, especially when using its location-based features

3. Location Services

RaceLauncher may use your device’s location (with your permission) to display nearby users on a map and help facilitate local races. Location access is optional and can be disabled at any time in your device settings.

We do not store historical location data or share your real-time location with third parties.

4. Intellectual Property

All content and features within RaceLauncher, including text, images, code, and branding, are the intellectual property of Argos Digital Media, LLC or its licensors.

You may not:

• Copy, reproduce, or redistribute any part of RaceLauncher
• Decompile or reverse-engineer the app
• Use RaceLauncher or its contents for commercial purposes without prior written consent

5. Disclaimers

RaceLauncher is provided on an “as is” and “as available” basis. We make no guarantees that the App will be error-free, uninterrupted, or meet your specific needs. You use RaceLauncher at your own risk.

We are not liable for:

• Injuries, accidents, or damages of any kind
• Misuse of the App during actual vehicle operation
• Legal issues arising from racing or unauthorized use of the App

By using RaceLauncher, you release Argos Digital Media, LLC from any responsibility related to how the App is used, whether on public roads, private property, or elsewhere.

6. Limitation of Liability

To the fullest extent permitted by law, Argos Digital Media, LLC shall not be liable for any indirect, incidental, consequential, or special damages resulting from your use of or inability to use RaceLauncher. This includes, but is not limited to, loss of data, injury, property damage, or legal consequences.

7. Termination

We reserve the right to suspend or terminate access to RaceLauncher at our discretion, with or without notice, if we believe you are violating these Terms or using the App inappropriately.

8. Modifications

We may revise these Terms at any time. Updates will be reflected by a new “Last Updated” date. Continued use of RaceLauncher after changes are posted constitutes acceptance of the new Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to conflict of law provisions. Any disputes must be brought exclusively in the courts located in that state.
